1. Scope
These terms cover the iOS and Android apps and the services needed to run them: parent accounts, child profiles, creations, conversations, the library and parental controls. They do not cover pre-orders or sales of the physical plush toy.
The Terms of Use are available before you accept them and in settings. Acceptance of these terms and consent to processing by AI providers are separate steps. Reading the Privacy Policy does not amount to consent to every type of processing.
2. An adult is responsible for the account
The account holder must be an adult with the authority needed to create and manage the child profiles. They must provide accurate information and protect their login details and parent PIN. Children must not create a PokoClub account on their own.
The parent chooses the permitted features and connects the Nyo & Cie child app. Nyo & Cie does not offer purchases to children. If an account is compromised or a profile was created without permission, contact us so we can investigate and take appropriate protective measures.
3. Features and access requirements
PokoClub lets you manage profiles, creations, settings and purchases. Nyo & Cie is the child’s space for permitted activities. Some features require an internet connection, a device permission, linked apps or a paid plan.
Compatibility is shown in the app store listing. Features, limits, creation costs and plan benefits are displayed in the app before use or purchase. You can withdraw device permissions in your device settings; features that depend on them will then stop working.
4. Nyo is an artificial intelligence
Nyo generates responses, stories, songs, images and other content from the information provided to it. Responses may be inaccurate, incomplete, repetitive or unsuitable despite safeguards. Use should remain supervised and appropriate to the child’s age.
Nyo does not replace a parent, teacher or healthcare professional and is not an emergency service. Summaries and observations from conversations are not diagnoses. In immediate danger, contact the relevant emergency services.
The parent reviews creations before making them available to the child. You can report problematic content through the available reporting features or our contact address. We review reports and may restrict or remove content to protect users.
5. Your content and creations
Only submit files, text, images and other material you are authorised to use. Avoid unnecessary personal information, especially a child’s full name, address, school or medical details.
You retain any rights you hold in your contributions. You authorise their processing, storage, technical adaptation and transmission to necessary service providers solely to deliver the requested feature, manage your content and keep the service secure. This permission is not a general transfer of rights or implied permission to train models.
Creations may be used personally and within the family, subject to third-party rights and applicable rules. We do not guarantee that AI-generated content will be unique or eligible for copyright protection.
Trademarks, characters, interfaces, software, brand voices and catalogue content belonging to PokoPlush or its licensors remain protected. These terms do not authorise their extraction or commercial exploitation.
6. Fair use and protection of the service
PokoClub and Nyo & Cie are intended for personal and family use by the profiles covered by your plan. Fair use protects service availability so that every family can benefit. Technical protection limits also apply to paid plans, including PokoClub+.
Examples of abuse include requests automated by unauthorised bots or scripts, looping generations without real interaction, creating multiple accounts to bypass limits or free allowances, sharing access beyond authorised users, and mass-producing content commercially for others. Frequent family use alone does not constitute abuse.
Where there is objective evidence of abuse, we may slow the affected requests, stop an automated process or temporarily restrict the feature involved. Any measure is limited to what is necessary in scope and duration. Except in a security emergency, fraud or where legally required, we explain the reason and ask you to correct the use before suspending access. Serious or repeated breaches may lead to account suspension; you can ask support to review the decision.
In addition to the credits, benefits and limits stated in your plan, technical anti-abuse limits apply, including to request volume or frequency. They are deliberately generous and designed not to be reached by the vast majority of family use. Exact thresholds are not published to limit circumvention. PokoClub+ is not a promise of unlimited use. Reaching a limit alone does not establish abuse: you can ask support to review your situation. These safeguards do not allow arbitrary reductions to purchased benefits; your statutory rights and remedies remain unaffected.
- Creating a profile without authority, impersonating someone or disclosing another person’s data.
- Producing or seeking illegal content, child exploitation material, hateful or harassing content, or dangerous content.
- Circumventing parental controls, safety filters, usage limits or payments.
- Disrupting the service, introducing malware or automating requests at scale without permission.
- Reselling access, sharing an account commercially or infringing third-party rights.
7. Availability, updates and liability
We maintain the service and provide necessary updates, including security updates. Maintenance, incidents or your connection may cause interruptions. Material changes to a paid service remain subject to consumer rights and the Terms of Sale.
No term excludes statutory guarantees, liability that cannot lawfully be limited, or mandatory consumer rights. The inherent limitations of AI do not release PokoPlush from its obligations.
8. Your choices, account closure and complaints
You can change features and profiles in PokoClub, exercise your data rights and delete your account. To withdraw AI consent, email us from the address linked to the account. Withdrawal may prevent features that require that processing from working, without affecting earlier lawful processing.
Deleting the app or your account does not automatically cancel an Apple or Google subscription. Also cancel it in the relevant store’s subscription settings.
These terms are governed by French law, without depriving consumers of the mandatory protections of their country of residence. Send complaints to our contact address. Available mediation and competent courts remain those provided for under consumer protection rules.
9. Changes to these terms
Each document has a version date. We notify you of important changes in the app or by email where required. We request fresh agreement when a change requires it. Changes do not retrospectively remove rights you have already acquired.
